Terms of Service
The terms and conditions that govern towing and transport services provided by M4M Towing Services Pty Ltd across Melbourne VIC.
1. Agreement to these terms
These Terms of Service govern your use of the website m4mtowingservices.online and any towing, roadside assistance, vehicle recovery or transport services supplied by M4M Towing Services Pty Ltd (ABN 99 703 111 773) of Melbourne VIC ("we", "us", "our"). By requesting a quote, placing a booking, or engaging our services, you agree to be bound by these terms. If you do not agree, please do not use our services.
2. Our services
We provide towing and related vehicle transport services, including emergency towing, breakdown assistance, accident recovery, and planned vehicle relocation within metropolitan Melbourne and surrounding areas of Victoria. The exact scope of any job will be confirmed in your written quote or booking confirmation.
3. Quotes and estimates
All quotes provided by us are estimates based on the information you supply at the time of enquiry. Final charges may vary where circumstances differ from those described, including vehicle condition, location access difficulties, time of day, or additional labour reasonably required to complete the job safely. We will inform you of any material variation before proceeding where it is practicable to do so.
4. Bookings and attendance times
Attendance times are estimates only. While we aim to respond promptly, particularly in emergency situations, we do not guarantee arrival within any specific timeframe, as traffic, weather, and demand may cause delays. Time is not of the essence in relation to attendance unless expressly agreed in writing.
5. Payment terms
Payment is due on completion of the service unless alternative credit arrangements have been agreed in advance in writing. We accept payment by the methods advised at the time of booking. Overdue accounts may attract interest and reasonable recovery costs. Goods and services tax (GST) is payable where applicable and will be shown on your tax invoice.
6. Cancellation
You may cancel a booking at any time. Where cancellation occurs after a tow truck has been dispatched, or where we have incurred costs in attending your location, a call-out or cancellation fee may apply to cover reasonable costs. Cancellations should be made by email to ceo@m4mtowingservices.online wherever possible.
7. Your obligations
You confirm that you are the owner of the vehicle or are lawfully authorised to request its removal or transport. You must remove or secure all personal belongings, declare any dangerous goods, and provide access, keys, and any information reasonably required for us to perform the service safely. We reserve the right to decline or discontinue a job where a vehicle or situation presents an unreasonable safety risk.
8. Vehicle storage
Where a vehicle is stored at our premises or an agreed storage facility, storage fees accrue at the rate notified to you. You remain responsible for collecting your vehicle within a reasonable period and for settling all towing and storage charges before release.
9. Liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, loss of use, or loss of opportunity. Our liability for any claim arising from our services is limited, where the law permits, to the cost of re-performing the service or the fees paid for the service concerned. Nothing in this clause limits liability for death or personal injury caused by our negligence or for any other liability that cannot lawfully be excluded.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied or your money refunded if the services fail to be of acceptable quality or do not match their description, and the failure does not amount to a major failure. These terms must be read subject to those statutory guarantees.
11. Insurance
We maintain appropriate insurance for our operations. You should notify your own insurer of any incident as soon as practicable, and we can provide documentation reasonably required to support an insurance claim arising from an accident recovery or towing engagement.
12. Force majeure
We are not liable for failure or delay in performing our obligations caused by events beyond our reasonable control, including extreme weather, natural disasters, road closures, industrial action, or interruptions to utilities and communications.
13. Privacy
Our handling of your personal information is set out in our Privacy Policy. By using our services, you consent to the collection, use and disclosure of your information as described there.
14. Complaints and disputes
If you are dissatisfied with our services, please contact us first so we can attempt to resolve the matter promptly. You may also seek information about your rights from Consumer Affairs Victoria or the Australian Competition and Consumer Commission.
15. Governing law
These terms are governed by the laws of Victoria, Australia, and the parties submit to the jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.
16. Changes to these terms
We may update these Terms of Service from time to time. The current version published on this website applies to any services engaged after the date of publication. Continued use of our services following an update constitutes acceptance of the revised terms.
